ARTICLE 1 – Scope

These Terms of Sale govern all sales made by the Seller to non-professional buyers ("the Customer") on goldandskye.com. The Products sold are digital sewing patterns (PDF files), downloadable immediately after purchase. The Customer should review each Product's details before ordering. The choice and purchase of a Product are the Customer's sole responsibility. By ticking the box provided before completing the order, the Customer confirms they have read and accepted these Terms. ARTICLE 2 – Prices

Products are sold at the prices shown on the site at the time of order, in euros, all taxes included. As these are digital products, no shipping fee applies. The Seller may change prices at any time; the applicable price is the one in effect on the day of the order.

ARTICLE 3 – Orders

The Customer adds Products to the cart, accepts these Terms by ticking the box provided, and proceeds to payment. Creating an account is optional. Each order forms a distance contract and is final only once the price is paid in full. A confirmation email is sent promptly.

ARTICLE 4 – Payment

Payment is due in full at the time of order, via the secure methods offered at checkout (credit card, PayPal and other displayed methods). Payment data is exchanged in encrypted form through approved payment providers. Payments are final only once funds are received.

ARTICLE 5 – Delivery of digital content

As the Products are digital, nothing is shipped. As soon as payment is confirmed, the Customer receives an email with a download link; the link is also available on the order confirmation page and, where applicable, in the customer account. The Customer must provide a valid email address and check their spam folder. If downloading fails, the Customer contacts the Seller at hello@goldandskye.com, who will resend the file promptly.

ARTICLE 6 – Right of withdrawal

Under article L.221-28 13° of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium where performance has begun with the consumer's prior express consent and express waiver of the right of withdrawal. By completing the order, the Customer expressly requests immediate performance (access to the file upon payment) and expressly waives their 14-day right of withdrawal. Accordingly, no withdrawal or refund may be claimed once the order is confirmed and the file made available.

If a problem occurs (download failure, faulty file, accidental duplicate purchase, or wrong pattern reported before downloading), the Customer should contact hello@goldandskye.com, and the Seller will find a solution (resend, swap, or refund as appropriate).

ARTICLE 7 – Legal guarantee of conformity

Digital Products carry the legal guarantee of conformity provided by the French Consumer Code for digital content and services. In the event of a lack of conformity, the Customer may obtain its correction or, failing that, a price reduction or termination of the contract, under the conditions set by law. To exercise these rights, the Customer notifies the Seller in writing (email). The Seller is not liable for misuse of the file or incompatibility with the Customer's own equipment. Photographs and illustrations on the site are not contractually binding.

ARTICLE 8 – Intellectual property and licence of use

All patterns, files, illustrations, text and content on the site are the exclusive property of the Seller and are protected by French and international intellectual-property law. Purchasing a pattern grants the Customer a strictly personal, non-commercial licence of use. The Customer may print the pattern for personal use and sew garments for themselves or their close ones. Sharing, reselling, distributing, making available or reproducing the PDF file, as well as any commercial use of the pattern, are prohibited without the Seller's prior written consent. Any unauthorised reproduction may constitute an infringement (contrefaçon).

ARTICLE 9 – Personal data

The Customer's personal data is collected and processed in accordance with the GDPR (Regulation (EU) 2016/679) and French data-protection law. Details on collection, retention and the Customer's rights are set out in the Privacy Policy. The Customer has rights of access, rectification, erasure, portability and objection, exercisable at hello@goldandskye.com, and may lodge a complaint with the CNIL.

ARTICLE 10 – Governing law – Language

These Terms and the transactions arising from them are governed by French law. They are written in French; in case of translation, only the French text prevails in the event of a dispute.

ARTICLE 11 – Disputes and mediation

For any complaint, the Customer first contacts the Seller at hello@goldandskye.com. Under articles L.612-1 et seq. of the French Consumer Code, the Customer may use a consumer mediator free of charge: the Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C), 14 rue Saint-Jean, 75017 Paris — cm2c@cm2c.net. The Customer may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. Failing an amicable resolution, any dispute will be submitted to the competent French courts.
